If a student produces the above documents after the course start date, he/she will receive a refund of course fees less the Registration Fee, the Course Deposit and less the fees for the corresponding number of course weeks that have passed. A REFUND CAN ONLY BE GIVEN IF A STUDENT VISA IS REFUSED AND NO OTHER REASON OR DOCUMENT WILL BE ACCEPTED. If a student is granted a visa for a time period less than the period they have paid to study for, the school will not refund any fees for the outstanding period. Refunds will be made a maximum of 5 weeks after Rose of York's Principal receives the necessary documents. If a student is granted a visa for a time period less than the period they have paid to study for, the school will not refund any fees for the outstanding period. 4 POSTPONING YOUR COURSE If you want to postpone your course we must receive notice before the date of your course start date. Notice received after the course start date will not be valid. No compensation will be given if a student arrives late or does not attend part or all of his/her course (including any period of absence or illness during the course). Compensation for any serious illnesses will be at the sole discretion of the Director. The Director's decision will be final. Courses for which the school has issued a 'formal letter of registration' cannot be postponed unless a student's visa has not been granted. 5 CHANGING COURSES and TIMES Small classes may be cancelled or merged with other classes due to low enrolment. We also reserve the right to change the times and teachers of classes. If you are moving from a less expensive zone to a more expensive zone (e.g. from zone 3 to zone 2) you must also pay the difference in price between the two zones for the whole of the length of your course, regardless of how long you have left to study. If, subsequently, you change back to a cheaper time zone, you will not receive a refund of any part of this payment, but you retain the option to move back to the more expensive zone. A student who has changed course times must buy the book of the new class, whether the time change was his/her decision or the school's decision. 6 ATTENDANCE At Rose of York we have a strict attendance policy because we have to follow the Home Office rules. The Home Office expects students to have 80-85% attendance. Students are allowed to miss 7 days per half-term (every 6 weeks). If they miss more than 7 days without providing a doctor's note or any other certificate, they will receive a warning. After the second warning, if it happens again, they will be expelled. There will be NO REFUND of fees. This policy is FINAL. Upon finishing, our students can obtain a certificate of attendance if they have attended at least 80% of their classes. Both the instructor and the college's principal sign this document. 7 HOLIDAYS All students must book holidays at least one week in advance and for a full week starting on a Monday (i.e. Monday - Friday). Students who wish to book a holiday with less than one week's notice may do so at the school's discretion. Holidays may not be taken for a week that has already started or carried over from one course booking to another. If a student would like to cancel a holiday, the above booking rules apply (i.e. it should be cancelled one week in advance). If a student attends class for any lesson during a week for when they have booked holiday, they automatically forfeit that week’s holiday and their records are completed as present/absent for that week. Their course details, attendance and finish date are amended automatically. Authorised course holidays are indicated on the school fees price list. These are not negotiable and can not be changed. There are no holidays for courses lasting less than 9 weeks. The school closes for 2 weeks over Christmas. Students do not study for this period, although it is not included in the ‘course holiday’. There is no reduction in the course fees where a course include public holidays (e.g. Bank Holidays). 8 LANGUAGE LEVEL If a student, after taking the College's level test, is found to be below the minimum start level for the course, the College reserves the right to place the student in a class with fewer lessons and different syllabus, with no right of financial compensation, to better suit the needs of the student until an appropriate level is reached. This also applies to Exam Preparation courses. 9 LIABILITY Rose of York is fully insured with Public Liability Insurance. Students are advised that the College, its employees and its representatives accept no responsibility for personal injury and/or loss of /damage to personal property on the college premises, whether by fire, burglary, theft or otherwise. This condition also applies to public and private places when students are on College trips / excursions. Rose of York is not responsible for the safekeeping or delivery of any fax, post etc sent to students at the College addresses. Nor is the College responsible for the safekeeping of exam results or certificates. 10 PHOTOGRAPHS Photographs of the students may be used in our promotional and publicity materials unless the student specifically objects. The school reserves the right to use all photographs in anyway the school sees appropriate in promoting itself and the copyright to all photographs shall belong to the school. 11 FORCE MAJEURE A basic stipulation of the agreement / contract between students and ROY, or its representatives, is that neither ROY or its representatives are liable for refunds or damages, however arising, in cases where ROY is unable to fulfil any services to which they are contractually bound because of labour disputes, insufficient demand for classes or other reasons which are beyond their control. 12 CHANGES TO THE TERMS AND CONDITIONSThe school reserves the right to amend or alter its terms and conditions without providing further notice. In such cases, any newer version automatically replaces a previous version and becomes valid for all courses and students from the date of its implementation.
